We retain your personal data for as long as is necessary for the decision regarding your application. Your personal data and application documents will be deleted no later than six months after the conclusion of the application process (e.g., upon notification of a rejection decision), unless a longer retention period is legally required or permitted. Beyond this, your personal data will only be retained to the extent required by law or, in specific cases, for the assertion, exercise, or defence of legal claims for the duration of legal proceedings.

In the event that you have consented to the longer retention of your personal data, we will retain such data in accordance with your declaration of consent.

Should an employment, apprenticeship, or internship relationship be established following the application process, your data will, to the extent necessary and permissible, initially continue to be retained and subsequently transferred to your personnel file.

Where applicable, you may receive an invitation to be included in our talent pool following the conclusion of the application process. This enables us to consider your profile for suitable vacancies in the future. Where your consent has been obtained, we will retain your application data in our talent pool in accordance with your consent or any future declarations of consent.

9. Your Rights

Every data subject has the right of access pursuant to Art. 15 GDPR, the right to rectification pursuant to Art. 16 GDPR, the right to erasure pursuant to Art. 17 GDPR, the right to restriction of processing pursuant to Art. 18 GDPR, the right to notification pursuant to Art. 19 GDPR, and the right to data portability pursuant to Art. 20 GDPR.

In addition, you have the right to lodge a complaint with a data protection supervisory authority pursuant to Art. 77 GDPR if you are of the opinion that the processing of your personal data is not being carried out lawfully. This right to lodge a complaint exists without prejudice to any other administrative or judicial remedy.

Where the processing of data is based on your consent, you are entitled pursuant to Art. 7 GDPR to withdraw your consent to the use of your personal data at any time. Please note that such withdrawal shall only take effect prospectively. Processing carried out prior to the withdrawal shall not be affected thereby. Please also note that we may be required to retain certain data for a specified period in order to comply with statutory requirements (see Section 8 of this Data Protection Notice).

Right to Object:

To the extent that the processing of your personal data is carried out pursuant to Art. 6 para. 1 lit. f GDPR for the purposes of safeguarding legitimate interests, you have the right, pursuant to Art. 21 GDPR, to object at any time to the processing of such data on grounds relating to your particular situation. We will then no longer process that personal data unless we are able to demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or unless the processing serves the assertion, exercise, or defence of legal claims.

10. Requirement to Provide Personal Data

The provision of your personal data in the context of application processes is voluntary. However, we can only make a decision regarding the establishment of an employment relationship, or enter into such a relationship with you, if you provide the personal data that is necessary for the conduct of the application process.

11. Automated Decision-Making

The decision regarding your application is not based on automated processing. Accordingly, no automated individual decision-making within the meaning of Art. 22 GDPR takes place.

12. Information Regarding the Recording and Transcription of Job Interviews

aedifion GmbH intends to record job interviews conducted in online meetings via the software Jamie as audio files for the purpose of generating transcripts. The transcription is based on a temporary audio recording of the respective meeting, which is automatically deleted upon completion of the transcription process.

Meeting recordings and transcriptions may be created as required for documentation purposes, to facilitate internal collaboration, for the follow-up of meetings and projects, and to make content available to employees who were unable to attend. Any use for the purpose of employee evaluation or behavioral monitoring is strictly excluded.

Meeting recordings and transcriptions are stored securely within our recruiting tool Tellent Recruitee. They are generally retained for a period of six (6) months from the date of the respective meeting, unless a longer retention period is required for operational or statutory reasons. Upon expiry of this period, all data will be permanently deleted.

The legal basis for the collection, storage, and use of the aforementioned data is the voluntary consent of the individual concerned (§ 26 Para. 2 BDSG). In order to ensure that consent is given voluntarily for each session and each applicant, we kindly request that you provide your prior general consent to the recording and transcription of meetings.

Consent is given on a voluntary basis. It may be withheld without the provision of reasons and without any resulting disadvantage to the individual concerned. Furthermore, this consent may be withdrawn at any time in written form (e.g., by email to peopleandculture@aedifion.com) with effect for the future. Any affected transcripts will be deleted without undue delay.

Should a recording or transcription during a conversation not be desired in an individual case — notwithstanding prior consent — the individual concerned is at liberty to express this verbally, irrespective of whether general consent has been granted within this declaration. In such cases, the transcription will either not be initiated or will be discontinued and deleted immediately.
